State's Attorney

Job Description

The State's Attorney is an appointed position that directs the activities of the State's Attorney's office and is responsible for the prosecution of all criminal and juvenile cases in McKenzie County. This position reports to the Board of County Commissioners until the election in 2026, in which it will return to an elected office. The schedule is Monday-Friday. Level and salary commensurate with experience. This position is not responsible for the civil duties associated with McKenzie County.

Essential Job Functions:

Prosecute and attend the District Court of conduct, on behalf of the State, all prosecutions for public offenses. This includes going through all criminal investigations/cases and determine what may not merit prosecution.
Advise law enforcement on how to follow various constitutional requirements and protections.
Act as legal advisor to Mountrail McKenzie Human Service Zone.
Institute proceedings on behalf of the McKenzie County Human Service Zone. This includes juvenile deprivation, juvenile delinquents, and unruly juveniles.
Supervise office staff including scheduling, work assignments/special projects, training, counseling, and evaluating.
Develop and/or implement policies and procedures, forms, work methods, schedules, job priorities to be followed and coordinate all Departmental work.
Initiate any civil or criminal asset forfeitures on behalf of the county.
Institute proceedings under chapter 25-03.1 for mental health involuntary commitment proceedings.
Minimum Qualifications:
License to practice law in North Dakota

Job Description

ABOUT THE ROLE:
Under supervision of the Burleigh County Sheriff, is responsible for inmates within the Detention Center, the protection of life and property, and to perform routine tasks in accordance with North Dakota law, rules and regulations established by the Attorney General of North Dakota and Burleigh Morton County Detention Center policies.

AM I QUALIFIED?

You are qualified if you have:
• Current driver’s license
• GED or High School Diploma
• Ability to work shift work (see "Shift Schedule")

You are not qualified if you have:
• Any felony level convictions
• Three or more misdemeanor convictions
• Any use of hard illegal drugs (meth, cocaine, heroin, fentanyl, ecstasy, etc.)
• Registered sex offender.
• Pending criminal case.

SHIFT SCHEDULE:
This position is a shift work position. Every other weekend off, twelve-hour shifts with one-month rotations alternating between night shift and day shifts. Officers work a long week then a short week with this repeating. Long weeks are working Monday, Tuesday, Friday, Saturday, and Sunday. Short weeks are just Wednesday and Thursday. Officers only work approximately 14 days per month.

OTHER REQUIREMENTS:
1. Must successfully complete standard background and a criminal record check along with physical and psychological exams. Costs associated with these exams will be paid for by the county.
2. Applicant must have the abilities to perform the essential functions, with or without accommodation which may include but not limited to: lifting, extended walking, carrying and dragging objects, climbing up to and down from elevated surfaces, climbing through openings, jumping over obstacles and using body force to gain entry.
3. Skills to communicate, verbally and written, with some knowledge of appropriate legal terminology for the purpose of legal and non-legal documents.

RESPONSIBILITIES:
• Responsible for the protection, life and property of inmates within the Detention Center.
• Process and release inmates, determine the appropriate classification of inmates; assess and respond to the needs of special populations. Conduct visual and audio surveillance of Detention Center.
• Gather information in criminal and administrative investigations by interviewing and obtaining statements of victims, witnesses and/or suspects. Prepare investigative reports and determine probable cause to recommend disciplinary action.
• Perform searches of people; this may include inspecting unclothed inmates, which may include exposure to bodily fluids and wastes. Perform searches of inmate correspondence items, and objects capable of concealment. Detect and collect evidence.
• Pursue fleeing inmates, perform rescue operations, and effectively restrain an inmate with restraints, forcibly if necessary.
• Transport and escort prisoners, detainees and committed mental patients, using appropriate restraints.
• Perform other duties as assigned which may include but not limited to, preparing and serving food, inspection of doors and windows to ensure security, and working rotating shifts.

ABOUT THE ROLE: Under the supervision of the Auditor/Treasurer, is responsible for supervision of clerical staff, tax collection function, accounting functions, preparing, balancing, and making daily bank deposits, and reconciling periodic statements of the County’s bank accounts.

CANDIDATE REQUIREMENTS:
• Bachelor’s degree in finance, accounting, or business administration and three (3) years of experience in accounting including banking and investing funds and/or an equivalent combination of education and experience.
• Preference will be given to applicants with two (2) or more years of supervisory experience.
• Knowledge of state and local laws governing the assessment and collection of real estate taxes.
• Knowledge of legal property descriptions and common property instruments such as warranty and quit claim deeds, death certificates, and plats.

PRIMARY JOB DUTIES:
1. Oversee the collection and recording of all county revenues; prepare and balance daily receipts and deposits of funds, prepare listing of all checks and cash, and reconciliation checking account(s) and periodic statements of bank accounts.
2. Prepare needed data for annual audit, internal report requests, maintain pledged securities.
3. Serve as an active member of the Burleigh County Investment Committee.
4. Assist in the annual budget preparation including calculation of tax levies, preparing assessment list/abstract, special assessment districts.
5. Assist in review of warrants and orders for payments issued by the county to determine whether they are legal obligations of the County, have been properly budgeted, and do not represent over payment to any payee or from any fund.

9. Create property tax statements, courtesy notices (two time a year), estimate statements, taxation notices, in lieu of taxes, public utilities (electrical and transmission) distribution lines – verifying, reporting, and billing.
10. Process year-end entries, perform rollover and annual closing processes for connection groups.
11. Supervise, train, process timekeeping, monitor workload, evaluate performance, and provide assistance to staff in the department.
